TERMS AND CONDITIONS

1. INTRODUCTION

  1. This document sets forth the Terms and Conditions (the “Terms”) governing the participation in skill-based competitions and giveaways (the “Competitions”) organised by SuperSport Competitions LTD (the “Organiser”), a company registered in England and Wales with Company No. 16266581 having its registered office at 11 High Croft, Durham DH78PP. The Organiser reserves the right to assign, transfer, or otherwise dispose of its rights and obligations under these Terms to any third party, including but not limited to any successor entity or purchaser of its business, without prior notice to Participants. Participants may not assign or transfer their rights or obligations under these Terms without the Organiser’s prior written
    consent. These Terms are binding on all participants (the “Participants”) who enter the Competitions through either online paid entry or free postal entry methods. Each Competition includes a mandatory skill-based question that must be answered correctly to qualify for entry. By entering any of the Competitions, Participants agree to be bound by these Terms.
  2. The Competitions are open to individuals who are at least 18 years of age at the time of entry and are legal residents of the United Kingdom with a valid proof of residence. The Competitions are subject to all applicable laws and regulations and are void where prohibited by law.
  3. It is the responsibility of the Participants to ensure that they are eligible to enter the Competitions under all applicable laws and regulations. By participating in the Competitions, Participants represent and warrant that they meet all eligibility requirements set forth in these Terms.
  4. The Organiser reserves the right to amend these Terms at any time with 30 days’ prior written notice to existing Participants via email or website notification. In cases of urgent regulatory compliance requirements or where immediate changes are required for security or fraud prevention purposes, the Organiser may make immediate amendments with notice being given as soon as practicable thereafter, provided that no amendments will be made to the competition question requirements or free postal entry process that would disadvantage existing entrants or alter the fundamental nature of the competition as a skills-based contest. Any amendments will be effective immediately upon posting on the Organiser’s website SuperSport Competitions. It is the Participant’s responsibility to review these Terms regularly to ensure they are aware of any changes.

2. ELIGIBILITY

By entering any of the Competitions, Participants agree to be bound by these Terms, including the following eligibility requirements:

  1. Participants must be at least 18 years of age at the time of entry.
  2. Participants must be legal residents of the United Kingdom.
  3. Employees of the Organiser, its affiliates, subsidiaries, advertising and promotion agencies, and suppliers, (collectively the “Excluded Individuals”), and immediate family members and/or those living in the same household of Excluded Individuals are not eligible to participate in the Competitions.
  4. Participants must possess a valid driver’s license at the time of accepting a car giveaway prize.
  5. The Organiser reserves the right to verify the eligibility of any Participant and may require such information as it considers reasonably necessary for this purpose.
  6. Entry may be refused or a prize withdrawn at any time if the Organiser believes that any Participant has not complied with these Terms.

3. ENTRIES

  1. Entries for the Competitions are available through (1) the Organiser’s official website or authorised platforms which include Facebook, or (2) free postal entry as detailed below. A maximum of 2000 entries will be available for each Competition, and the Organiser will clearly display the remaining number of available entries on its website in real-time. The Competition will automatically close once this limit is reached, even if this occurs before the scheduled end date. In such cases, no further entries (including postal entries) will be accepted, and any postal entries received after this point will be returned. Any entry made outside of these official channels will not be considered valid.
  2. Entry Process for Competitions (Online Method):
    1. visit the Organiser’s official website or authorised platforms;
    2. select the specific Competition you wish to enter;
    3. review the Competition details, including prize information and specific terms;
    4. choose the number of tickets you wish to purchase (subject to the maximum limit per Participant, if any);
    5. complete the entry process by providing required personal information in English language, payment (if applicable), correctly answering the
      competition question in English language, and providing consent for the use of personal information for marketing purposes as detailed in the Data Protection section;
    6. receive confirmation of entry via email or on the website, including confirmation of the competition question answer submitted; and
    7. retain your ticket confirmation for reference.
  3. Entry Process for Competitions (Postal Entry): Participants can enter the Competitions without any purchase by submitting a free postal entry. To do so,
    Participants must send a postcard or letter containing their full name, address, date of birth, contact information, and the answer to the skill-based competition question to the Organiser’s designated postal address 11 High Croft, Durham DH78PP. All postal entries must be written in English language. The postal entry must be received by the Organiser before the competition closing date. Each postal entry must be submitted individually in a separate envelope with correct postage; bulk entries will not be accepted. The Organiser is not responsible for any postal delays or entries
    lost or damaged in transit. Participants using the postal entry method are subject to the same eligibility requirements and terms as those entering online.
  4. Participants must be 18 years of age or older and must reside in the United Kingdom. Proof of age and residency may be required.
  5. The price for online entries in each Competition will be clearly stated on the Organiser’s official website at the time of entry. Prices are subject to change at the Organiser’s discretion without prior notice. No purchase is necessary as free postal entries are available as detailed in these Terms.
  6. All entries, whether paid online or free postal entries, are final and non-refundable, except in cases where: (i) the Competition is cancelled or postponed by the Organiser; (ii) the Participant exercises their statutory cooling-off period rights within 14 days of entry; (iii) there is a material change to these Terms that disadvantages the Participant; or (iv) where required by applicable consumer protection laws. In such instances, Participants will be offered the choice between a full refund within 14 days or transferring their purchase to a subsequent Competition. The Organiser reserves the right to cancel, postpone or modify any Competition at its sole discretion, including but not limited to cases where: (i) the minimum number of tickets required for viability is not sold, (ii) technical or operational issues affect the integrity of the Competition, (iii) fraud or tampering is suspected, (iv) cybersecurity
    incidents occur, (v) force majeure events including but not limited to natural disasters, pandemics, war, civil unrest, or changes in law make it impossible or impracticable to proceed, or (vi) circumstances beyond the Organiser’s reasonable control make it necessary to do so. In case of cancellation, all Participants will receive a full refund of their entry fee within 30 days.
  7. By purchasing a ticket, Participants agree to be bound by the Terms and the specific rules of the Competition, which will be made available on the Organiser’s official website.
  8. Excluded Individuals are not eligible to purchase tickets or win prizes in the Competitions.

4. PRIZE DETAILS

  1. Each Competition will have one or more specific prizes, with exact details including make, model, specifications, approximate retail value, and the skill-based competition question (which will test the entrant’s knowledge, judgment or skill in a specific area) clearly outlined in the competition-specific information. For vehicle prizes, this will include full vehicle specifications, including year, model, trim level, colour, and standard/optional equipment. For cash prizes, the exact amount will be specified. For other prizes, a detailed description including brand, model, and full specifications will be provided, ensuring Participants have complete and transparent information about the prizes being offered. Minor variations in specifications, colours, or features may occur due to manufacturer changes or availability, and the Organiser reserves the right to substitute items of equal or greater value in such
    circumstances.
  2. Prizes are non-transferable and cannot be exchanged for cash unless (i) explicitly stated in the specific competition terms, (ii) required by applicable law, or (iii) agreed in writing by the Organiser at its sole discretion. Any permitted transfer or exchange shall be subject to such additional terms and conditions as the Organiser may impose. In cases where a cash alternative is offered, it will be clearly stated in the specific competition information. The Organiser reserves the right to substitute the prize with another of similar value without giving notice. Participants are responsible for any taxes, insurance, and other expenses that are not explicitly included in the prize description.
  3. By entering the Competitions, Participants agree to accept the prize as offered and acknowledge that the prizes are awarded “as is” with no warranty or guarantee, either express or implied, provided by the Organiser, except for any manufacturer’s warranty that may apply to physical prizes and any statutory rights that cannot be excluded under consumer protection laws. The Organiser is not responsible for any dissatisfaction concerning any prize or any damages, losses, or injuries that result from accepting or using the prize.

5. DRAW AND WINNER SELECTION

  1. The draw for the Competitions will be conducted by the Organiser under the supervision of an independent adjudicator appointed by the Organiser who shall be a qualified professional with relevant experience in competition administration or similar role. In the event that the appointed adjudicator becomes unavailable, the Organiser may appoint a substitute adjudicator of similar qualification. The draw will include only entries (whether paid online or free postal) that have correctly answered the skill-based competition question, demonstrating the required knowledge, judgment or skill, as determined by the Organiser and verified by the adjudicator. The draw process will be recorded and documented to ensure transparency and fairness. The draw will take place on a publicly announced date, at a time and location specified by the Organiser, and may be attended by Participants and the general public, subject to any restrictions or conditions imposed by the Organiser or
    relevant authorities.
  2. The winner(s) of the Competitions will be selected at random from all eligible entries (both online and postal) that have correctly answered the competition question and were received prior to the closing date. All valid entries, whether paid or free postal entries, have an equal chance of winning. Winners will be notified by email and telephone (using the contact details provided with their entry) within seven (7) days following the draw using all reasonable efforts. If a winner has not claimed their prize within twenty-eight (28) days of the initial notification attempt, the Organiser reserves the right to select an alternative winner. The Organiser reserves the right to verify the eligibility of all entrants, including but not limited to the requirement that
    the winner(s) must not be Excluded Individuals.
  3. In the event that a selected winner is ineligible, cannot be contacted within seven (7) days, or fails to claim the prize within twenty-eight (28) days of initial notification, the Organiser reserves the right to withdraw the prize from the winner and pick a replacement winner or to cancel the prize. The Organiser’s decision in respect of all matters to do with the Competitions will be final and no correspondence will be entered into.
  4. By participating in the Competitions, Participants agree to be bound by these Terms and the decisions of the Organiser, which are final and binding in all respects. The Organiser is not responsible for incorrect or inaccurate transcription of entry information, for any technical malfunctions, lost/delayed data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software, inability to access any online service or website, or any other error or malfunction, or any injury or damage to participant’s or any other person’s computer related to or resulting from participation in these Competitions.

6. WINNER NOTIFICATION AND PRIZE CLAIMING

  1. The winner(s) of the Competitions will be selected at random from all eligible entries that have correctly answered the competition question and were received by the closing date, whether through paid online entry or free postal entry. The Organiser will notify the winner(s) via email or telephone (using the details provided at entry) within seven (7) days of the draw. If a winner cannot be contacted or is not available, or has not claimed their prize within twenty-eight (28) days of the initial notification attempt, the Organiser reserves the right to withdraw the prize from the winner and
    pick a replacement winner.
  2. After successfully claiming the prize, winners will receive their prize through the following delivery method: Physical prizes will be shipped to the winner’s provided address within 30 days of prize verification, subject to availability, supply chain conditions, manufacturer delays, and any other circumstances outside the Organiser’s reasonable control. The Organiser shall not be liable for any delays in prize delivery caused by third-party suppliers, shipping companies, customs clearance, or other factors beyond its direct control. Winners acknowledge that delivery times are estimates only and may vary based on circumstances. The Organiser reserves the right to substitute a prize of equal or greater value if the original prize becomes unavailable due to circumstances beyond its control. Cash prizes will be transferred via bank transfer or check within 14 business days.
  3. For vehicle prizes, the winner must be personally present at the delivery address to accept the prize. At the time of delivery, winners must: (i) present their valid driving license for verification, (ii) complete and sign the V5 vehicle registration document, and (iii) sign an acceptance form acknowledging receipt and assuming responsibility for the vehicle. Third parties, including friends and family members, cannot accept
    delivery on behalf of the winner. The Organiser will cover standard delivery costs for prizes, with any expedited shipping or special handling at the winner’s expense. Winners are responsible for providing accurate delivery information and must be available for the scheduled delivery time.
  4. Winners must provide a valid form of identification and complete an affidavit of eligibility, which includes confirming their compliance with all Competition rules, verifying their age, residency, and that they are not an Excluded Individual. Failure to complete the affidavit within the specified timeframe may result in forfeiture of the prize. The Organiser reserves the right to verify all information provided in the affidavit and is not responsible for any delays in prize delivery due to the winner’s provision of incorrect or incomplete information.
  5. All decisions made by the Organiser regarding the selection of winners and all other aspects of the Competitions are final and binding. No correspondence will be entered into.
  6. By entering the Competitions, Participants agree to be bound by these Terms and acknowledge that the Competitions are not open to Excluded Individuals. Participation in the Competitions constitutes acceptance of these Terms.

7. DATA PROTECTION AND PRIVACY

  1. In compliance with the Data Protection Act 2018, the UK General Data Protection Regulation (UK GDPR), and the Privacy and Electronic Communications Regulations (PECR), the Organiser commits to ensuring the protection and privacy of all personal data collected from Participants in the course of the Competitions. The Organiser maintains appropriate technical and organisational measures to protect personal data against unauthorised or unlawful processing and against accidental loss, destruction, or damage, but cannot guarantee the absolute security of data transmitted over the internet. The Organiser shall not be liable for any breach of security that is outside its reasonable control or for any actions of third parties
    who may obtain unauthorised access to any Personal Data despite the Organiser’s reasonable security measures. Participants acknowledge this limitation and accept the inherent risks of online data transmission. This includes, but is not limited to, personal identification information such as names, addresses, email addresses, phone numbers, and any other personal data collected during the competition entry process or subsequent communications. The Organiser maintains a detailed record of all data processing activities and conducts regular security assessments to
    ensure compliance with data protection regulations.
  2. Personal data collected will be used primarily for the purpose of administering the Competitions, including ticket allocation, winner selection, and prize distribution. Additionally, by entering the Competition, Participants explicitly consent to the Organiser using their name, image, and personal information for marketing and promotional purposes related to the Competitions and future competitions organised by the Organiser, subject to applicable data protection laws and the right to withdraw such consent at any time. This consent includes the right to use such information in
    various media platforms, including but not limited to websites, social media, print, and digital communications. For vehicle prize winners, the Organiser may film and record the prize delivery and the winner’s initial reaction for promotional purposes, unless the winner objects on religious or other reasonable grounds. Such footage may be used on the Organiser’s website, social media platforms, and other marketing materials. Winners may request not to be filmed by notifying the Organiser in advance of the delivery.
  3. Participants have the right to access, correct, delete, restrict processing, object to processing, and request portability of their personal data held by the Organiser at any time, in accordance with applicable data protection laws. Requests regarding personal data should be directed to the Organiser’s designated Data Protection Officer at 11 High Croft, Durham DH78PP.
  4. The Organiser will not share, sell, or distribute personal data to third parties except (i) where explicitly consented to by the Participant (including marketing consent provided at entry), (ii) as required by law, (iii) as necessary for the direct administration of the Competitions, or (iv) to the Organiser’s group companies and successors in title. Such necessary third parties may include prize delivery services, identity verification providers, payment processors, and independent adjudicators. All such third parties will be bound by appropriate data processing agreements ensuring the security and confidentiality of personal data.
  5. All personal data will be held and processed in accordance with the Organiser’s privacy policy, which is available at supersportcompetitions.co.uk/privacy-and-data-protection-policy. Participants are encouraged to review this policy to understand their rights and the Organiser’s obligations in relation to personal data protection.

8. LIMITATION OF LIABILITY

  1. All personal data will be held and processed in accordance with the Organiser’s privacy policy, which is available at supersportcompetitions.co.uk/privacy-and-data-protection-policy. Participants are encouraged to review this policy to understand their rights and the Organiser’s obligations in relation to personal data protection. The Organiser shall not be liable for any loss, damage, injury, or any other claim arising from or in connection with the participation in the Competitions, including but not limited to: (i) any inability to enter due to technical issues, system downtime, or high volumes of traffic; (ii) any errors in the processing of entries or competition
    answers; (iii) any loss or damage to prizes during delivery; (iv) any tax liability incurred by winners; (v) any costs associated with prize collection or use; (vi) any cybersecurity incidents, data breaches, or unauthorised access to personal data by third parties despite reasonable security measures being in place; (vii) any loss or corruption of data during transmission; (viii) any consequential or indirect losses; (ix) any losses arising from compliance with laws, regulations or regulatory guidance; (x) any losses arising from changes in market conditions or circumstances affecting prize values or availability; and (xi) any other losses arising from circumstances beyond the Organiser’s reasonable control, including but not limited to any losses arising from technical failures, system errors, or circumstances beyond the Organiser’s reasonable control, except in cases of death or personal injury caused by the Organiser’s negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable consumer protection laws. This limitation of liability applies to all Participants and Excluded Individuals.
  2. Subject to applicable consumer protection laws, the Organiser shall not be liable for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, automated entry systems, bot attacks, DDoS attacks, or any other malicious technical interference, or any combination thereof. The Organiser reserves the right to disqualify any entries it reasonably believes to have been made using automated systems, bots, scripts, macros, algorithmic methods, artificial intelligence tools, or any other automated means of entry, including any injury or damage to Participant’s or any other person’s computer related to or resulting from participation in the Competitions.
  3. Subject to the Consumer Rights Act 2015, the Consumer Protection from Unfair Trading Regulations 2008, and other mandatory consumer protection laws of England and Wales, Participants agree that the Organiser (including its officers, directors, employees, and agents) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if the Organiser has been advised of the possibility of such damages), arising out of or in connection with the Competitions or the Terms.
  4. Nothing in these Terms shall limit or exclude the Organiser’s liability for:
    1. death or personal injury caused by its negligence;
    2. fraud or fraudulent misrepresentation;
    3. any other matter for which it would be illegal or unlawful for the Organiser to exclude or attempt to exclude its liability.
  5. By entering the Competitions, Participants agree to release, discharge, and hold harmless the Organiser from any and all liability, loss, damage, or injury resulting from participation in the Competitions.

9. INTELLECTUAL PROPERTY

  1. All content included on the Organiser’s website, including, but not limited to, text, graphics, logos, images, audio clips, digital downloads, data compilations, software, competition questions, answers, and associated methodologies, is the property of the Organiser or its content suppliers and protected by the United Kingdom and international copyright laws. Any unauthorised use, reproduction, or distribution of such content may result in legal action. The compilation of all content on this website is the exclusive property of the Organiser and protected by UK and international
    copyright laws.
  2. The trademarks, service marks, and logos (“Marks”) used and displayed on the Organiser’s website are registered and/or unregistered Marks of the Organiser or its affiliates. No part of the Organiser’s website and no Marks may be copied, reproduced, republished, uploaded, posted, transmitted, distributed, or collected through automated means (including but not limited to scraping, crawling, or using automated data collection tools) without the Organiser’s prior written consent, except as permitted by applicable copyright laws including fair dealing for the purpose of criticism, review, or news reporting. Any attempt to circumvent the website’s technical protection measures or security features is strictly prohibited.
  3. Participants may not use any Marks appearing on the Organiser’s website without the prior written consent of the Organiser. Unauthorised use of the Marks or any other content displayed on the Organiser’s website may violate copyright and trademark laws and could result in criminal or civil penalties.

10. COMPLAINTS AND DISPUTES

  1. In the event of a complaint or dispute arising in relation to any aspect of the Competitions, including but not limited to the competition question evaluation or postal entry processing, the Participant must submit their complaint in writing to the Organiser within 14 days of the incident. Failure to submit a complaint within this timeframe shall constitute an irrevocable waiver of any right to dispute or claim in relation to that incident. The complaint should provide a detailed account of the issue, including any relevant dates, times, and evidence where applicable.
  2. The Organiser will acknowledge receipt of the complaint within 7 days and aims to resolve all complaints within 28 days of receipt. The resolution process will involve a thorough investigation of the complaint, including review of competition question answers and postal entry records where applicable, during which the Organiser may contact the Participant for further information.
  3. If the Participant is not satisfied with the resolution provided by the Organiser, they may escalate their complaint to an independent adjudicator agreed upon by both parties. The decision of the independent adjudicator will be considered final and binding on all parties.
  4. Participants agree that, by entering the Competitions, they are bound by these Terms and will not bring any claim against the Organiser related to any decision made by the Organiser or the independent adjudicator regarding the resolution of complaints or disputes.
  5. This complaints and disputes procedure is governed by the laws of England and Wales and is subject to the exclusive jurisdiction of the courts of England and Wales.

11. GOVERNING LAW AND JURISDICTION

These Terms, and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation, shall be governed by and construed in accordance with the law of England and Wales. The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with these Terms or its subject matter or formation (including non-contractual disputes or claims).

12. AMENDMENTS TO TERMS AND CONDITIONS

  1. The Organiser reserves the right to amend these Terms with 30 days’ notice to the Participants, except where immediate amendments are required for regulatory compliance, security, or fraud prevention purposes, in which case notice will be given as soon as practicable. Any changes to the competition question requirements or postal entry process will not apply retrospectively to existing entries. Any amendments will be posted on the Organiser’s website and will become effective immediately upon posting. It is the responsibility of Participants to review the Terms
    regularly to ensure they are aware of any changes. By continuing to participate in the Competitions after any amendments to the Terms have been posted, Participants agree to be bound by the amended Terms.
  2. In the event of any discrepancy between the current version of the Terms and any previous version(s), the provisions of the current version shall prevail, except where such changes would adversely affect rights accrued under previous versions for Competitions already entered. All Competition entries must be submitted in English language. Entries in any other language will not be accepted or considered valid.
